Process & Industrial Developments Ltd (defendant/appellant) v The Federal Republic of Nigeria (claimant/respondent)

By Appellant’s Notice issued on the 25 January 2024, this is an appeal against the Order of Robin Knowles J dated 21 December 2023 sitting in the Commercial Court.

The issue of principle is in relation to costs, independent of the main judgment.

The underlying proceedings mainly involved an application by Nigeria to set aside two arbitration awards of a tribunal comprising Lord Hoffmann, Sir Anthony Evans and Chief Bayo Ojo SAN (“the Awards”). The Awards were issued in 2016 and 2017 and dealt with liability and quantum respectively. By the Awards, the tribunal found Nigeria liable to P&ID for repudiatory breaches of a contract for the construction of a gas processing facility in Nigeria, and awarded P&ID damages of US$6.6 billion plus interest.

The applicant in this case is the Local Authority, who seek to appeal the final declaration/order in relation to the cessation of covert medication and change of residence for A.

Thakkar & ors (appellants) v Mican & anr (respondents)

By appellant’s notice filed on 12 August 2023, this is an appeal against the Order dated 24 July 2023 of Mr Justice Richard Smith sitting in the Business and Property Courts (Chancery Appeals) in which he dismissed the Appellant’s appeal against the order of HHJ Backhouse sitting in the Central London County Court refusing indemnity costs against an unsuccessful defendant who had alleged fundamental dishonesty by the Appellant (and ordering that the Applicant pay the Respondent’s costs in the first appeal).

The Financial Conduct Authority (appellant) v Seiler & anr (respondents)

By an Appellant’s Notice filed on 14 December 2023, the FCA appeal the decision, dated 9 November 2023 of the Upper Tribunal (Tax Chamber) in which he awarded the Respondents’ costs in relation to the tribunal proceedings in respect of one transaction and 5% of the Respondent’s costs in relation to the remainder of the proceedings.

King Crude Carriers SA & ors v Ridgebury November LLC and ors

Appeal against the Order of Dias J dated 15 December 2023, sitting in the Commercial Court, that allowed appeals under Section 69 of the Arbitration Act 1996.

The judge dealt with two separate appeals under the Arbitration Act 1996 relating to four arbitrations under four separate but related contracts for the sale of four second-hand oil tankers.

Each contract was concluded between one of the Claimant companies and one of the Defendant companies. The contracts were all on materially identical terms and the disputes which arose in relation to each were likewise the same. Accordingly, the four arbitrations were heard together.
